These Terms of Service ("Terms") govern your use of the hearback.net website and the services provided by Rakesh Patel dba Hearback ("Hearback," "we," "us," or "our"). By using our website or services, you agree to these Terms. If you don't agree, please don't use them.
The service
Hearback provides a lead-response service for businesses that automatically sends and manages text messages — such as replies to inbound inquiries and follow-ups — on a business's behalf. Our website also lets you request a demo and learn about the service.
SMS messaging terms
These terms apply to our text messaging program:
- Program. Hearback (and the businesses that use it) send conversational and follow-up text messages to people who have contacted them or otherwise opted in.
- Consent. By opting in — for example by checking the SMS box on our form, or by calling or messaging a business that uses Hearback — you agree to receive text messages related to your request. Consent is not a condition of any purchase.
- Message frequency. Frequency varies based on your interaction; for a single inquiry you may receive an initial reply and up to a few follow-up messages.
- Cost. Message and data rates may apply, according to your mobile plan.
- Opt-out. Reply STOP at any time to stop receiving messages. You may receive a final confirmation that you've been unsubscribed.
- Help. Reply HELP for assistance, or email info@hearback.net.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier conditions.
Acceptable use
You agree not to misuse the website or services, including by attempting to disrupt them, access them without authorization, or use them for unlawful purposes.
Intellectual property
The website, the Hearback name and logo, and related content are owned by us or our licensors and are protected by applicable laws. You may not copy or use them without permission.
Disclaimers
The website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Rakesh Patel dba Hearback will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or services.
Changes to these Terms
We may update these Terms from time to time. We'll post the updated version here and revise the "Last updated" date. Continued use after changes means you accept the updated Terms.
Governing law
